Important: All persons who will be operating bike and/or paddleboard equipment MUST submit a separate waiver. If a rider is 18 or under, a parent or guardian must sign the waiver and accompany them at all times.

1. Assumption of Risk

I understand and acknowledge that:

Riding an e-bike or stand-up paddleboard involves inherent risks, including but not limited to falls, collisions, physical injury, and property damage. Road, trail, and water conditions, weather, and traffic can significantly affect safety and may be unpredictable. I voluntarily choose to participate and freely assume all risks, known and unknown, associated with using Salty Spokes equipment. Helmets and other protective gear reduce but do not eliminate the risk of injury.

2. Customer Responsibilities I will wear the provided helmet at all times while riding. I will obey all applicable traffic laws, local ordinances, and trail rules. I will not operate any rented equipment while under the influence of alcohol, drugs, or any impairing substance. I will not permit any other person to use the rented equipment. I will return all equipment in the same condition as received, reasonable wear and tear excepted. I accept full financial responsibility for any damage to or loss of equipment beyond normal wear and tear.

3. E-Bike Rules I will not modify, tamper with, or attempt to repair the e-bike's motor, battery, electronics, or controls. I understand the maximum rider weight capacity is 300 lbs and confirm I am within this limit. I understand the top pedal-assisted speed is approximately 20 mph and will ride at a safe speed for current conditions. I will charge the battery only with the provided charger, indoors, in a dry location away from flammable materials. I will lock the e-bike with the provided lock whenever it is left unattended.

4. Paddleboard Rules (if applicable) I understand that stand-up paddleboarding involves risks including drowning and other water-related hazards, and I confirm adequate swimming ability. I will not paddleboard in weather, current, or wave conditions that exceed my ability level. I will wear a personal flotation device (PFD) when required by law or when conditions make it necessary.

5. Equipment Responsibility I am solely responsible for all rented equipment from the time of delivery until pickup by Salty Spokes staff. I will promptly notify Salty Spokes of any damage, malfunction, accident, or theft by calling (205) 370-9984. I understand that loss or theft of equipment will result in charges at full replacement value. I will not leave equipment in an unsecured or publicly accessible location without locking it.

6. Release of Liability

In consideration of being permitted to use Salty Spokes equipment, I agree as follows:

I hereby release, waive, discharge, and covenant not to sue Salty Spokes E-Bike Rentals, its owners, officers, employees, agents, and volunteers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while using rented equipment. This release applies to negligence on the part of Salty Spokes to the fullest extent permitted by applicable law. I understand this is a complete and unconditional release of all liability to the greatest extent allowed by law.

7. Indemnification I agree to indemnify, defend, and hold harmless Salty Spokes E-Bike Rentals, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with my use of rented equipment. I agree to indemnify Salty Spokes for any damage or injury caused to third parties by my operation of rented equipment.

8. Medical Authorization I authorize Salty Spokes staff and emergency personnel to obtain emergency medical treatment on my behalf if I am incapacitated and emergency care is necessary. I confirm that I am in good physical health and have no medical conditions that make e-bike riding unsafe for me without medical supervision. I consent to the release of necessary medical information to emergency personnel if required during a rental incident.

9. Acknowledgement I have read this entire agreement, understand its contents, and agree to be bound by its terms. I understand this is a legally binding contract and I am signing it of my own free will. I confirm that I am at least 18 years of age, or if under 18, that my parent or legal guardian is completing this waiver on my behalf. I agree that this electronic agreement is as valid and legally enforceable as a handwritten signature.
